The bench, however, clarified that its order shall not affect the election petition, if any, is filed before the jurisdictional high court.
“Needless to say, any observation made herein concerning the basis of rejection of petitioner’s nomination is only for the purpose of appreciating the facts of the case and nothing contained in this order shall affect the election petition, should any election petition is filed by the petitioner or any other person before the concerned High Court,” the top court said.
The matter was mentioned by senior advocate Abhishek Singhvi yesterday before a bench of Justices P K Mishra and A S Chandurkar, which said it will be listed on Friday, subject to curing of defects, if any.
BJP’s Madhya Pradesh general secretary Rahul Kothari had filed an objection to Natarajan’s candidature with the RO, alleging that she had failed to fully disclose details of a case against her in the affidavit submitted with her nomination papers. Kothari was referring to a private complaint pending before a court inHyderabadagainst various individuals.
